Trademark law doesn't stop someone from making similar games, but it does stop someone from making games that can appear to be products or endorsed by the creator of the original game. While gameplay elements aren't protected by copyright (and aren't patented here.and patenting gameplay elements is a murky field, without a lot of precedent), it's definitely the case that Microsoft could make a very plausible claim that "Minetest", which shares a similar name, look, and gameplay, could very, very easily be confused by an end user with "Minecraft". While Mojang may have been pretty casual about trademark infringement and not have a lot of in-house lawyers, Microsoft just made a $2B investment, and is much more of a risk. Gnomescroll: Multiplayer survival game set in surreal environments. It has been in development and use since October 2010. Minetest: Minetest is an infinite-world block sandbox game and a game engine, inspired by InfiniMiner, Minecraft and the like. But it's OK because there are tons of Minecraft Alternatives available for Linux that are almost as good as the original.
For me, I think there plans are going to be bad and gimmicky to find more ways to rack up the cash. With Minecraft just getting bought by Microsoft for 2.5B one can only question what plans Microsoft has with there new toy.
